Understanding the National Security Law’s Full Impact
The National Security Law enacted by Beijing in June 2020 is the single most consequential piece of legislation in Hong Kong’s post-handover history more consequential in its practical effects on daily life and civil liberties than the handover itself. Its four main offences secession, subversion, terrorist activities, and collusion with foreign forces have been applied to journalists, politicians, activists, trade unionists, academics, and ordinary citizens in ways that have fundamentally altered the city’s political and social landscape. The UN Human Rights Office has identified multiple provisions of the law as incompatible with Hong Kong’s obligations under the International Covenant on Civil and Political Rights.
The NSL and the End of Apple Daily
The most prominent application of the National Security Law to journalism was its use against Apple Daily and its founder Jimmy Lai. Lai was charged with collusion with foreign forces a charge that encompasses his engagement with foreign governments, international press freedom organisations, and overseas journalists as a media proprietor. The freezing of Apple Daily’s parent company assets under the NSL made continued publication materially impossible. Reporters Without Borders described the application of the NSL to Apple Daily as a direct attack on press freedom using national security law as the instrument.
NSL Prosecutions Beyond the Media
The National Security Law has been applied far beyond the media sector to encompass pro-democracy politicians, activists, trade unionists, and ordinary citizens. The prosecution of the Hong Kong 47 pro-democracy activists for their participation in an unofficial primary election resulted in convictions for 45 of the 47 defendants in March 2024. Amnesty International and Freedom House both described the convictions as politically motivated and fundamentally incompatible with the rule of law.
